1. Agreement to Terms

By accessing and using Hey, Andy! ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Hey, Andy! is a messaging-based health coaching service designed to provide personalized support for individuals taking GLP-1 medications. Our service includes:

• Personalized health coaching via RCS (Rich Communication Services) or SMS
• Medication reminders and tracking
• Health goal support and guidance
• AI-powered health insights and support

3. Communication Methods and Consent

By registering for Hey, Andy!, you consent to receive communications via RCS (Rich Communication Services) or standard SMS text messaging. We use RCS as our primary communication channel because it provides end-to-end encryption and enhanced security for your health information.

SMS Fallback: If RCS is not available on your device or through your carrier, our system will automatically use standard SMS text messaging to ensure you maintain access to our Service. You acknowledge and agree that:

• Standard SMS is not encrypted and may be less secure than RCS
• Message and data rates may apply based on your carrier's plan
• You are responsible for any charges imposed by your mobile carrier
• You can opt out of SMS communications at any time by replying "STOP" to any message

We strongly recommend using a device and carrier that supports RCS for optimal security and privacy protection of your health information.

4. Eligibility

You must be at least 18 years of age to use this Service. By registering, you represent and warrant that you are 18 years of age or older. Hey, Andy! reserves the right to refuse service to anyone who does not meet these eligibility requirements.

5. Disclaimer of Medical Advice

IMPORTANT: Hey, Andy! does not provide medical diagnosis, treatment, or prescription services. Our Service is for informational and supportive purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment from a licensed healthcare provider.

Always consult with your healthcare provider before making any changes to your medication, diet, or exercise routine. In case of medical emergency, please call 911 or go to the nearest emergency room.

6. User Responsibilities

You agree to:

• Provide accurate and complete information during registration
• Maintain the confidentiality of your account credentials
• Use the Service only for lawful purposes and in compliance with these Terms
• Not impersonate any other person or entity
• Not upload malicious code or attempt to disrupt the Service
• Report any unauthorized access to your account immediately
• Comply with all applicable laws and regulations

7. Subscription and Billing

Pricing:

Subscription pricing is as stated on our pricing page. We reserve the right to change pricing with 30 days' written notice.

Billing Cycle:

Subscriptions are billed monthly, quarterly, or annually depending on your selected plan. Your subscription will automatically renew on the same day each billing period unless cancelled.

Cancellation:

You may cancel your subscription at any time by contacting support@heyandy.health. Cancellations are effective at the end of your current billing period. No refunds will be issued for partial months or unused services.

Late Payment:

If payment fails, we will attempt to collect payment using the payment method on file. If payment remains unsuccessful after multiple attempts, we reserve the right to suspend or terminate your account.

8. Intellectual Property Rights

The Service, including all content, features, and functionality (including but not limited to all information, software, text, displays, images, video and audio), is owned by Hey, Andy!, its licensors, or other providers of such material and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your personal use. You may not reproduce, distribute, transmit, display, perform, publish, or transmit any content without our prior written permission.

9. User Content

Any information, messages, or content you submit to Hey, Andy! may be stored and processed in accordance with our Privacy Policy. You retain ownership of any content you provide, but grant us a non-exclusive license to use, display, and process your content for the purpose of delivering our Service.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HEY, ANDY! SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HEY, ANDY! DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hey, Andy! and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or in connection with your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time, for any reason, with or without notice, including if we believe you have violated these Terms or applicable laws. Upon termination, your right to use the Service will immediately cease.

14. Modifications to Service

Hey, Andy! reserves the right to modify, suspend, or discontinue the Service, in whole or in part, at any time, with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in California.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms of Service and our Privacy Policy constitute the entire agreement between you and Hey, Andy! regarding your use of the Service and supersede all prior and contemporaneous agreements, understandings, and negotiations.
